Rights and Benefits for Faculty

Please refer to the teacher's manual webpage for teachers' rights.

Items Regulations
Profession Level University faculty is divided into four levels: Professor, Associate Professor, Assistant Professor, and Lecturer, responsible for teaching, researching, and counseling.
Term Employment Period Initial-contract is valid for one year, so is the first extended employment. Each of the following continuing contract lasts for two years.
Salary Assessment
  1. The level of teachers’salary is approved according to one's degree and  seniority.
  2. New faculty's salary will be paid from the date of arrival. If the faculty registers before the employment, the salary will be paid from the starting date of employment.
  3. If the new faculty has a full-time job and will resign after the employment (e.g. August 1st, 2005), the salary will be paid from the date of resignation. (e.g. ugust 16th, 2005.)
  4. According to the regulations of Ministry of Education, the faculty's salary can be assessed based on one's seniorities after acquiring a highest  degree (PhD, master's degree),a year a grade.
Registration
  1. Degree Verification: For faculty holding overseas degree which is not issued by schools in Taiwan, please go through degree verification process in Embassies,Ministry of Foreign Affairs. Please submit one copy of degree certificate approved by R.O.C Ministry of Foreign Affairs and a transcript. Teacher Certificate will be issued by the Ministry of Education after all the documents are submitted.  
  2. Certificate of Work Experience and Service: Please attach certificates of employments after the completion of the highest education(PhD, master's degree)if any.  
  3. Physical Checkup: Please have a physical checkup at any of Taiwan's public hospitals within three months after arrival.  
  4. Work Permit: Foreign faculty members can be employed after the successful application for work permit issued by Bureauof Employment and Vocational Training, Council of Labor Affairs, the Executive Yuan.  
  5. Resident Visa: Apply for Resident Visa in Taipei City Police Bureau. Upon arriving in Taiwan, work permit is required.  
  6. Bank Account: Please open an account at Taiwan Post Co., Ltd. For pay transfer.
Promotion
  1. Calculation of Promotion Quota
    • 1.1 Quota for associate professors promoted to the rank of professorship:The number of existing associate professors in each college × 1/5 × 2/3
    • 1.2 Quota for assistant professors promoted to the rank of associate professorship: The number of existing assistant professors in each college × 1/5
    • 1.3 Quota for instructors promoted to the rank of assistant or associate professorship: The number of existing instructors in each college × 1/5
  2. Promotion Criteria Except that each department or college establishes stricter bylaws, the university regulations are set as follows:
    • 2.1 Lecturer to Assistant Professor:
      • 2.1.1 As lecturer for three years and above, or a profession related to teaching subject for more than 4 years after getting master's degree, or with a PhD.
      • 2.1.2 With excellent teaching and service, research publications equivalent to doctoral thesis.
    • 2.2 Assistant Professor to Associate Professor:
      • 2.2.1 As assistant professor for three years and above, or a profession related to teaching subject for more than 4 years after getting PhD.
      • 2.2.2 With excellent teaching and service, and publish valuable research.
    • 2.3 Associate Professor to Professor:
      • 2.3.1 As associate professor for three years and above, or a profession related to teaching subject for more than 8 years after getting PhD.
      • 2.3.2 With excellent teaching, service and research, and have significant academic achievements.
Insurance

Teachers, on duty, have to join Government Employees' and School Staffs' Insurance (GESSI) and National Health Insurance.

  1. The items of payment of Government Employees' and School Staffs' Insurance (GESSI) include disability benefit, old age benefit, death benefit and dependents’ funeral allowance.
    • 1.1 Disability Benefit:
      • 1.1.1 Total Disability: 36-month insured payment if on duty; 30-month insured monthly payment if due to sickness or accidents.
      • 1.1.2 Hemi-disability: 18-month insured payment if on duty; 15-month insured monthly payment if due to sickness or accidents.
      • 1.1.3 Partial Disability: 8-month insured payment if on duty; 6-month insured payment if due to sickness or accidents.
    • 1.2 Old Age Benefit: The maximum benefit payable amount is set to 36-month insured salary.
    • 1.3 Death Benefit:
      • 1.3.1 36-month benefit would be provided for service-connected death.
      • 1.3.2 30-month benefit would be provided for non-service-connected death. However, 36-month benefit would be provided for more than 20 years of insured seniority.
    • 1.4 Dependents’ Funeral Allowance:
      • 1.4.1 Parents or spouse of the insured died: 3-month insured monthly payment.
      • 1.4.2 Children’s death: That age between 12 and 25, 2-month funeral allowance would be payable.; for the age less than 12 and infants already registered of their births by competent government agency, 1-month funeral allowance would be payable.
    • 1.5 Maternity Benefits:
      • 1.5.1 2-month benefit would be paid for childbirth or premature labor.
      • 1.5.2 In case of a plural birth resulting from childbirth, the payment shall be increased proportionately.
    • 1.6 Parental Leave Allowance:The parental Leave Allowance is calculated and Provided on a monthly basis, based on 60% of the insured salary. For each child, the parent can receive a maximum of six months' allowance. The allowance is provided in monthly cycles.
  2. The criteria of application : The insured with Booklet for Physical or Mental Disability by the Law of Protection for Physical or Mental Disability should be eligible to apply for the disability benefit within 5 years since the onset of disability. Furthermore, the insured, who was eligible to the criteria both of Physical and Mental Disability and of the provision under the Government Employees’ and School Staffs’ Insurance in the meantime, should select one of them whatever is the most favorable to apply for the disability benefit.
  3. Relevant Regulations of National Health Insurance
    • 3.1 IC Card Application: Fill out IC Card Application Form page 1 and attach a 2” photo. Please glue a copy of both covers of the resident certificate to the back of the application form. If applying because of damage, information/photo change, missing, etc, one should pay NT$200 and fill out page 1~3. For re-application, please pay the fee at the post office.  
    • 3.2 Additional Insurance for Individual: Initiated from the date of arrival. (For new faculty, if the previous working organization has paid for the insurance fee of the month, the insured date will start from next month) Send to Personnel Office the Amendments to Application for NHI attached with Application for Health Insurance Transfer Out of the previous insured organization and a copy of both covers of alien resident certificate.  
    • 3.3 Additional Insurance for Dependents: Qualifications for joining the insurance program include unemployed spouse, parents, children under 20, or children over 20 but still students.  
    • 3.4 Withdrawal of Individual or Dependents: Process when changing insured organization or status, e.g. resignation, retirement, employment of spouse, termination of adoption, divorce, and children turning ineligible for continuing insurance. If the individual transfers out, so will the dependent(s).  
    • 3.5 Suspension of Individual or Dependent(s) because of Going Abroad  
      • 3.5.1 The insured can choose to suspend the insurance if planning to go abroad for more than 6 months. During the suspension, insurance fee will not be charged.
      • 3.5.2 During the suspension, one can not re-enroll the insurance abroad. One will not enjoy NHI medical care until the re-enrollment in Taiwan.
      • 3.5.3 If applying for insurance suspension during staying abroad, the suspension date starts from the date of application. One can not track back to leaving date to process suspension; neither can process a make-up suspension.
      • 3.5.4 Please complete the procedure 7 days before departure.
    • 3.6 Re-enrollment in NHI of Individual or Dependent(s) when returning
      • 3.6.1 The insured who have been overseas for over 6 months, please process the re-enrollment and start paying the insurance fee from the date of return; those who have been overseas for less than 6 months, the re-enrollment date will start from the suspension date, and the insurance fee during suspension still should be paid.
      • 3.6.2 Complete the procedures when returning to Taiwan. Fill out the Amendments to Application for NHI and attach the copy of the entire passport of the insured. (Blank pages included).
Payment

Pay is divided into salary and payment of academic research.

Directors will receive an additional pay.

Welfare
  1. Wedding Subsidy: 2-month salary.
    • 1.1 Re-marrying the same one is not qualified.
    • 1.2 If husband and wife are both civil servants, the wedding subsidy can be applied for separately.
  2. Childbirth Subsidy: 2-month salary.
    • 2.1 Be eligible for oneself or your spouse's delivery.
    • 2.2 If husband and wife are both civil servants, only one childbirth subsidy can be applied for.  
    • 2.3 If bearing in other countries, please register R.O.C. citizen in Taiwan before applying for the childbirth subsidy.  
    • 2.4 All eligible payments must first be claimed under Government and School Staffs' Insurance(GESSI) policy before claiming under NTU. This claim will be proceeded and settled under GESSI insurance policy first and the balance will then claimed under NTU.  
  3. Funeral Subsidy: Parents or spouse passed away, 5-month salary; children passed away, 3-month salary.
    • 3.1 Be eligible for parents and spouse who are not civil servants.
    • 3.2 Husband and wife or relatives who are all civil servants can only apply once for the same dead.  
    • 3.3 Be eligible for faculty whose children are under 20, unmarried, and unemployed.  
  4. Dependent Education Subsidy: According to the amount proclaimed by the Executive Yuan.  
    • 4.1 Be eligible for faculty whose children officially study at school (from public/private primary school to university) in Taiwan, Penghu, Kinmen or Matsu. 
    • 4.2 If husband and wife are both civil servants, only one can apply for dependent education subsidy.  
  5. Please apply for the subsidies listed above within 3 months after wedding, childbirth, death, or other registered items. Subsidies will be based on one’s salary of the month the event takes place.  
  6. For faculty members of organization over 40, NT$2,100 is subsidized once for physical checkup every three years.  
  7. Faculty and family can enroll to be a member for the NTU Faculty Medical Cooperation Society.  
    • 7.1 Every year submit duration : From 1st December to 31st December.
    • 7.2 The faculty membership annual fee is NT$600 per person. The faculty’s dependents and retired faculty’s spouse is adjusted to NT$800 per person.
Leave of Absence
  1. Personal Leave (7 days), Home Leave (7 days): Please process in advance. Faculty who has been working in NTU for less than 1 year, days of personal leave will be calculated according to the number of your working months. Home leave is regarded as personal leave.  
  2. Sickness Leave (28 days), Menstrual Leave (1 day/ month): If more than 2 days,a certificate of a legal medical institute or hospital is required. Menstrual leave is regarded as sick leave.  
  3. Wedding Leave (14 days): Please provide the wedding invitation. According to actual needs, wedding leave can be taken advanced but need to be completed within 1 month after the wedding.  
  4. Pre-delivery Leave (8 days): For the first time, please provide Doctor's certificate or Pregnant Women Health Handbook. Pre-delivery leave can be applied for separately, at least 1 hour per time but can not be reserved after delivery.  
  5. Paternity Leave (3 days): A certificate of a legal medical institute or hospital is required.Paternity leave can be taken 3 days before or after one’s spouse’s delivery (separately), at least half a day per time. If one's spouse pregnant over five months miscarries, 3 days of paternity leave will be given.  
  6. Maternity Leave (42 days): Birth Certificate is required; 42 days a time; National holidays are not included.  
  7. Miscarriage Leave: A certificate of a legal medical institute or hospital is required; 42/21/14 days a time.  
    • 7.1 Miscarriage Leave (42 days): Miscarriage for pregnancy over 5 months.
    • 7.2 Miscarriage Leave (21 days): Miscarriage for pregnancy over 3 months and under 5 months.
    • 7.3 Miscarriage Leave (14 days): Miscarriage for pregnancy under 3 months.  
  8. Funeral Leave: Please provide an obituary. The mourning leave can be taken separately, at least half a day per time, but need to be completed within 100 days.
    • 8.1 Funeral Leave (15 days): For those whose parents or spouse passed away.
    • 8.2 Funeral Leave (10 days): For those whose step-parents, parents-in-law, or children passed away.
    • 8.3 Funeral Leave (5 days): For those whose great-grandparents, grandparents,grandparents-in-law, step-parents-in-law or siblings passed away.  
  9. Marrow or Organs Donation Leave: A certificate of a legal medical institute or hospital is required. Be approved according to actual needs.
Go Abroad
  1. Faculty must apply before they go abroad, no matter for what reason they are leaving the country.  
    • 1.1 Application for admission of entry and exit and application for passport are not required to be verified by NTU. However, faculty is not supposed to go abroad without permission.
    • 1.2 Faculty must apply to go abroad even if it's during the summer or winter vacation. They will still receive their paychecks during the summer/winter vacation, with only a small amount of transportation subsidies deducted from their salary.  
  2. Meeting, Conference, Field Study, Sight-seeing, Visit Relatives  
    • 2.1 Faculty who plan to go abroad must apply online(http://misweb.cc.ntu.edu.tw/abroad/topframe.aspx)before departure. Relevant certificate documents are required for field study, conference,and meeting.
    • 2.2 Summer and winter vacation is preferred for sight-seeing.
    • 2.3 Instruction for the online operation.  
  3. Research  
    • 3.1 The applicant have to be approved before 2-month.
    • 3.2 Send to Personnel Office the exit notification within 5-day departure, and the entry notification within 5-day returning.
Sabbatical Leave
  1. For full-time professors or the associate professor who have served for a consecutive period of 3.5 years, a full semester of sabbatical leave is granted (or a full year of sabbatical leave is granted to professors who have served as full-time professors 7 years)if with academic publication or research papers accepted by peer-reviewed academic journals within three years.  
  2. The number of professors allowed taking leave in each department should not exceed 15% of the total number of full-time professor in the said department every semester. To avoid any impact on teaching, the total number of faculty on sabbatical leave, domestic/international advanced study (research, lecturing), and temporary transfer is stipulated “not to exceed 16% of the total number of faculty (excluding teaching assistants)”.  
  3. The calculations of tenure have to take the following conditions into account: temporary transfer, leave with/without pay, expanding recruitment, visiting professors, and the tenure reserved from previous leave.  
  4. Within three months of the return from sabbatical leave, faculty shall submit a copy of report to university. Failure to submit a report of accomplishments following the sabbatical leave or submit a report not compatible to his/her sabbatical leave proposal may affect faculty eligibility for future sabbatical leave.  
  5. Professor on sabbatical leave is eligible to continue his/her administrative director position but have to have deputy director unless the case is earmarked by special approval. The acting assignment is stipulated by relevant regulations.
Part-time Academic/
Administrative Director
Native teachers can take positions as part-time academic/administrative directors. Foreign teachers can take positions as part-time academic directors such as Vice-president, Dean, and Department/ Institute Chairperson.
Temporarily Transfer, Part-time Job, Part-time Teaching
  1. Teachers are not allowed to have another part-time teaching or part-time job except the law permits. Teachers are required to obtain permission from NTU to be temporarily transferred, have another part-time job, or part-time teaching.  
  2. Teachers should meet the required teaching credits first to have a part-time teaching; and then other school should send a notice to ask for NTU's agreement, 4 hours a week at most.  
  3. For teachers who are also directors, salary of one part-time job can not exceed NT$8,000, and salaries of two part-time jobs can not exceed NT$15,000. For teachers who are not directors, monthly payment of the part-time jobs can not exceed NT$104,820.  
  4. For full or associate professors who do not hold a NTU administrative post and who apply for a part-time job at a for-profit business institution or group that has made a cooperation agreement with the University, If the duration of the part-time job is more than six months, the organization where the teachers work part time should pay a certain amount of academic feedback cash to NTU.
Retirement
  1. Relevant relation regulations of Pension Fund :
  2. Teachers should join the Pension Fund according to the regulations and pay the self-withdrawal savings monthly.  
  3. Retirement is divided into voluntary retirement and compulsory retirement.
    • 3.1 School faculty under any of the following conditions may apply for retirement:
      • 3.1.1 Who has served for at least 5 years and has reached the age of 60.
      • 3.1.2 Who has served for over 25 years.  
    • 3.2 School faculty under any of the following conditions shall retire:
      • 3.2.1 Who has reached the age of 65.
      • 3.2.2 Who is mentally incapacitated or physically disabled to the extent not capable of delivering services. School faculty who has reached the age stipulated in Subparagraph 1 of the preceding paragraph may at the request by the school of services and at own will of continuance of services apply with the competent authorities of education administration for extension of services up to 5 years.
    • 3.3 Relevant Regulations:
      • 3.3.1 Any voluntary retirement faculty who plans to retire should apply in written form 4 months ahead of the valid date of retirement. The application should include date and reason of retirement and should be approved by your director, dean and president. Send to Personnel Office.
      • 3.3.2 Personnel Office should send the retirement application to the Ministry of Education 3 months ahead of the valid date. If not, the applicant is required to sign a letter of consent.
      • 3.3.3 The retirement application will be approved by the Ministry of Education before the valid date.
      • 3.3.4 Faculty who has teaching experiences in private schools can receive a pension of private school after approval of the Ministry of Education.
Faculty Rights

According to Article16, Teacher's Act,after the teacher accepts employment, s/he can enjoy the following rights in accordance with the relevant laws and school rules and regulations:

  1. Brings up constructive opinions on teaching and administration of the school.
  2. Enjoys the rights and protections in terms of payment, fringe benefits, retirement, consolation, severance, and insurance, etc.
  3. Participates in in-service education, research, and academic exchanges.
  4. Joins teachers’ organizations, and attend other activities held in accordance with the regulations.
  5. Appeal in accordance with the law when the measures taken by the authorized educational authorities or schools against the teacher are considered by him/her to be illegal or inappropriate and have damaged his/her interests.
  6. Enjoys professional autonomy in teaching and student counseling in accordance with law and school rules and regulations.
  7. Can refuse to take part in work or activities irrelevant to teaching assignments by the authorized educational authorities or the school, unless otherwise specified according to law.
  8. Enjoys other legitimate rights in accordance with this law or other laws.
Faculty Obligations

According to Article 17, Teacher’s Act, other than fulfilling their employment responsibilities in accordance with law, teachers have the following obligations:

  1. Abides by the regulations specified in the employment contract and maintains school honor.
  2. Actively protects students’ rights to education.
  3. Implements teaching activities in accordance with relevant laws and the courses arranged by the school.
  4. Guides and disciplines students to grow adaptively and develop sound personalities.
  5. Conducts research and studies related to teaching.
  6. Takes full responsibilities of the position and exalts a teacher’s dignity and profession out of clear conscience.
  7. Attends academic and administrative activities of the school, as well as social education activities in accordance with relevant laws.
  8. Shall not disclose personal or family information of students unless otherwise specified by law.
  9. Takes the role of a homeroom teacher. 10. Fulfills other obligations in accordance with this law or other laws.
Resignation
  1. Without proper reasons, teachers can not resign before the expiration of the contract.  
  2. Notice in writing is required to be sent to inform NTU a month before expiration of the contract if teachers plan not to continue to teach in NTU. If resigning while the contract is still valid, teachers can not resign without permission from the university authority.
Contract Termination, Temporary Termination of Contract, Rejection of Continuing Contract

According to Aritcle14, Teacher's Act, after employed, the teacher may not be dismissed, suspended, or denied a renewed employment unless involved in one of the following situations:

  1. Being sentenced to a prison term for more than one year without probation.
  2. Being convicted of corruption and malfeasance, or being issued a warrant of arrest, the case of which not settled yet during the term of civil service.
  3. Being dismissed from the employment in accordance with the law, or undergoing the disciplinary action of suspension from employment with the penalty not yet terminated, or being suspended from employment due to the indictment with the case not yet cleared.
  4. Being deprived of civil rights with the rights thereof not yet been reinstated.
  5. Being issued an interdiction, with the interdiction thereof not yet been revoked.
  6. Being verified by the authorities concerned to have behaved inappropriately and therefore impaired the teacher’s morals and dignity.
  7. Being proved to have a mental disorder by a qualified physician. 8. Not fulfilling a teacher’s duties or being incompetent in teaching with concrete facts or severe violation of the employment contract.
